What are Party Wall Surveys?

The surveys – or agreements – are performed by two qualified surveyors, each working on behalf of the property owners involved in the dispute. Occasionally, our party wall surveyors will be contracted to work for both. 

Crossbow Developments will begin with a Service of Party Wall Notice, a letter of acknowledgement for a neighbour to complete and return. Two months’ notice is required for building works that will affect a party wall or property boundary line, with one month for excavation work. This is followed by a Schedule of Condition, a document outlining the adjoining property's current state. Should any damage occur during the construction works, the schedule is referred to ascertain the outcome.

The overall findings will include a legally binding report which details the following:

  • The details relating to the proposed works

  • Instructions for the safeguarding of the adjoining property

  • Access rights and working hours for stakeholders

  • The responsibilities relevant to parties named in the party wall agreement

Party Wall etc. Act 1996

This law was enacted to mandate the completion of party wall agreements where certain construction works are planned. Its immediate aim is to prevent and resolve all issues between stakeholders and achieve a favourable outcome that is satisfactory to all. The long-term objective of the Party Wall etc. Act 1996 provides a framework for construction works where neighbouring properties may be affected.
